CTA sets timeline for SkyGreece

While the Canadian Transportation Agency will not proceed with an expedited complaint process against SkyGreece Airlines, the carrier has been given until Sept. 16 to address obligations to stranded passengers as outlined in its International Passenger Rules and Fares Tariff.
In its assessment of a request by airline passenger advocate Gabor Lukacs to quickly deal with his complaint (filed on behalf of the airline’s stranded passengers), the CTA ruled that:
“Dr. Lukacs has provided no evidence that there is an imminent risk that SkyGreece will deal with its assets in a manner that would deprive passengers of their rights to recourse. Moreover, despite requesting an expedited process, Dr. Lukacs has introduced substantial complexity into an already complex matter by requiring SkyGreece to provide responses to extensive written questions and to produce documents. The Agency agrees with SkyGreece that this will prove to be a time-consuming endeavour, particularly in view of the context in which it is now operating. In order to satisfy Dr. Lukacs' request for more information, and to ensure that the issues before the Agency are fully and fairly adjudicated, an expedited process, as described in the Decision, is not possible.”
However, with regard to the airline’s obligation to adhere to the terms and conditions of its tariff concerning delayed and cancelled flights, the CTA has given SkyGreece until Sept. 16 to provide its answer; Lukacs will then have until Sept. 21 to provide his reply.
SkyGreece has also been given until Sept. 8 to respond or object to questions and documents requested in Lukacs’ complaint, including inquiries into the airline’s corporate structure and finance.
Lukacs has responded to the CTA assessment with a request for an interim order directing SkyGreece to rebook stranded passengers on other airlines within 24 hours; a decision on the interim request is yet to be released by the CTA.
